Property issues in Divorce

If I divorce, I would want to keep my home. I would not qualify for the mortgage ( I work part-time/homemaker). What usually happens in this case? If my father was willing to buy out my husband, would we have to go thru the whole bank approval process, title search, closing, etc? Is there an easier way to transfer ownership?

What usually happens when a couple divorces and property is to be transferred is that a quitclaim deed is done. This does not change the financing. As to the financing, if another person with sufficient resources to support the mortgage is willing to sign on then you can work out financing. Depending on what is put in the decree as to when the refinance is to be done you may have some flexibility (time).
