Protecting Child..

How would a father go about getting custody when the childs mother continues to be involved in a relationship in which the boyfriend is abusive to the mother? The boyfriend has charges for domestic violence pending against another women currently.

If you and the mother have a parenting plan/child support order where she's named the primary residential parent of your child, your option is to file a modification in the same court where the initial decree was entered.

Your allegation would be what you are saying here - that the environment where the child resides is detrimental to the child's best interests, and thus the child would be better off with you.

If you and the mom are both equally fit parents, this becomes a custody battle. Depending on who ultimately prevails, this could be messy and costly for you - or for her.
