Legal Question in Family Law in Washington
Relocation of child
I have majority custody of my 6 year old daughter. Her father gets her on wensday from 6pm to 8pm and every other weekend. I want to move to a town that is an hour and a half away but he is saying he will fight me. I tried to explain that he wont lose any of his visitation or weekends. He still says he will fight me. How can he fight me? He isn't losing anything! SO, can he stop me from moving to another town in the same state if he still gets his daughter the same amount of time???? What do I have to do to move??

Re: Relocation of child
You can move anywhere in your school district without seeking court approval, but if you are moving an hour and a half away, that sounds out of your school district.
He can fight you but chances are he will lose so long as you provide appropriate notice. The forms - the summons and the petition for relocation are on the Court's website. You serve them on him and file them with the court where you were divorced.
He cannot "fight" you and expect to "win" so long as you give him proper notice of your untent to relocate.
The court will see that, as you say, he isn't losing anything, and they'll allow you to relocate.
All you have to do is follow the relocation act. There is a summary in your parenting plan.
Hope this helps. Powell
