Legal Question in Family Law in Washington
remaned child dependency case
so they are going to court on the 21st of august to vacate the order of dependency and set a new trial date, I was just informed of that today by my court appointed lawyer ,he don't call me and tell me when court is or anything, I need to fire him for ineffective assistance of counsel, anyway, my question is at the new fact finding what do they go by the evidence they used in the first one or can they use stuff from after they denied me counsel and declared my children dependent as to me. should I put in a motion to supress? and when they vacate the dependency and set a date for fact finding does that mean we are again in shelter care status? because the appeals lawyer told me that when I'm in shelter care status that is when I let it be known how they illegally ordered someone to take my kids and for no reason allow me to get them until cps could get some kind of paper work on monday. they were just at my house the day before they had no reason to take my children then but the next day they did this, they did that on saturday, I went that day and sunday with a officer to get my kids but was met with a empty house, they left town with my children, because they were honestly scared if they gave them back they would go to jail

Re: remaned child dependency case
When you cannot work with your court appointed attorney, you fire them. You say to them, "You are fired" and they have to appoint a new attorney for you.
Promise. Start there.
Before you file any motions, before you do anything else, get a new attorney.
CPS plays hard ball, I know you noticed. They will use everything they have to run circles around you. Take the advantage that you have - your right to counsel - and utilize it.
Nobody at CPS or the state is going to jail over this. This is their JOB.
Gary Preble in Olympia does dependency work. You can find him at wsba.org under lawyer directory. I can't tell where you are, but you need counsel, not directions without all the facts.
