remove my name from Mortgage

we've divorced in Sept., 2005. my ex-husband doesn't want to refinance the mortgae. I've heard only way to remove my name from mortgage is he have to refinance.

how can I remove my name from the mortgage without him?

Refinancing is generally the only way off of a mortgage. Does your decree have a specified time to effect getting your name off the mortgage? If it does you could go to court and seek an order to compel him to effect the decree. If it does not have a specified date or period to effect getting your name off the financing, you will just have to wait.

You can't, unfortunately. Your remedy is contained in the language of your decree.

There may be something else he would 'trade' for this. Consider whether negotiating for something he wants would work for you.
