Legal Question in Family Law in Washington
residential custody
I have residential custody of our daughter and her father has residential custody of our son. I allowed my daughter to go live with her father this past school year under the agreement she to would return to live with me. She is now living with me and he wants to have her return next year. I am opposed to this as I do not feel that it is good for her to be change residence every other year. Our communication has always been strained and I am concern that when she goes to visit this summer she will not be sent back. Our divorce decree states that our daughter resides with me and our son resides with him. There is no further parenting plan in place. What should I do?

Re: residential custody
This is either an older case a case that was handled in another state or something went wrong, because any case handled in WA state in the last 15 years should have a parenting plan. Among many things I can't tell from your statement, I can't whether both of you live in WA. There are several facts that would influence my recommendation about what to do and even what you can do. If this is important to you, you should consult with an attorney who can address all the facts underlying this situation.
