Legal Question in Family Law in Washington
Re: Can we wed without my being responsible for his debts?
My fiance' and I want to get married, but haven't because of his rising medical bills and coart fines, (He doesn't want to burdon me with the costs). Is there any way we can legally marry, and the coarts and hospitals wont come after me? As far as the Hospital bills are concerned, they haven't stopped comming nor will they in the future, (My fiance' has an ongoing condition for the rest of his life, and the hospitals have sent his payments to collections). Even if we could marry, and it wouldn't effect me for his past bills, would it effect me from the day of our wedding--on? Considering both debts are pre-existing, and on going? Thank you.

A prenuptial agreement may help with defining separate property and liabilities from the past, and the future. You would effectively opt yourselves out of Washington's community property laws by defining everything you have as separate property and separate debt. You would need to be scrupulous in your adherence to the agreement, and even then you could expect to have to fight with creditors about debts, and you could expect that you will have difficulty making any purchases that require financing (as most will expect a community act to create the debt and acquire the property), and you may have troubles getting credit cards.
