Reversal of Custody

Why is it nearly impossible for me to gain custody of my son when his father has been found in contempt of court for not allowing visitation, and now there is a founded case of physical abuse against a minor (our son) on his record with child services? I am a good parent, have a wonderful husband and loving home. We have never been in trouble with the law. We are not and have never had alcohol or drug problems. And the clencher is that my son really wants to live with us. I have an attorney, but would just like added input about what is wrong with family law in this country.

As you have an attorney, it is unethical for me to give you any advice because that would be an unauthorized interference with your existing attorney-client relationship. However, I am wondering why your ex-husband got custody in the first place? Once determined by a court, custody is very difficult to change absent some very compelling circumstances. This is not a question of philosophy of law; rather, it is one of dealing with a case on its facts, both past and present. I would have a serious discussion with your present attorney about what is and is not happening in your case and why. Good Luck to you.
