Legal Question in Family Law in Washington
RE: Review Hearings & Trail Date
I've been Divorced for three yrs. & have had on going problems w/former wife. (contempt,DV, and CPS Investigations, kids hate me & it's all my fault etc.) She has had two attorneys and they have both withdrew as console when they see that I deal with truth & facts & I've been doing it pro-se with help from UNITED FATHERS OF AMERICA IN SEATTLE. She just put a DV on me & I got it dismised now she has a review hearing on the 18th and I've had nothing but problems seens the Comm. told her she had a review hearing and I had to get a hearing date set. I've got everything documented for past three yrs. need to know what happens now and what does a review hearing and trial date have to do with all of this. I have done a declaration RE:Review Hearing. Just want to know the if this is my chance for full custody?

Re: RE: Review Hearings & Trail Date
It's a little difficult for me to tell what is happening in your case regarding this "review hearing." It sounds like she filed a petition for a domestic violence protection order, which was then dismissed (presumably pursuant to the "return hearing" after a temporary order for protection was issued). Are you saying she has filed a motion for revision of the order dismissing her petition, or has she filed another motion/petition? If it's a motion for revision, the court won't consider new evidence. If it's another motion/petition, then you have to respond as you have.
In any event, I do not think that a domestic violence action is the appropriate forum for a change in "custody." If you want to change the residential schedule for your children, you should file a petition to modify your current parenting plan/custody decree.
