Legal Question in Family Law in Washington
revoking temporary custody
I gave my mom temporary custody of my children about a year ago because I was using drugs. Now that I am clean and wish to bring my boys back to live with me she is trying to make it difficult for me to do so. I was wanting to ask how I would go about revoking the temporary custody order that I signed. Do I have to go to court or is it just a matter of going and picking up my children?

Re: revoking temporary custody
Well it depends on what you mean by "gave my mom temporary custody". Did you go to court, enter orders, anything like that? Are there restraining orders requiring you to stay away from her or the kids? Have you been seeing your kids regularly? Are they in school? Is picking them up going to disrupt that? Do you live in the same school district?
If there is an order giving her custody and you signed it you have a huge problem. The answer is going to depend on where you are in this process. Please ask your county Bar association for a referral to a local attorney who practices family law, and take the existing orders with you so the attorney can review them.
If a court has made a placement decision and you decide to unilaterally change that, you could face contempt charges. Please tread carefully.
