Legal Question in Family Law in Washington

Scared to death!

My husaband I mutually signed CR2A with the rest of our paperwork, and now 3--name removed--before the final orders were to be presented, he chaged his mind. Can he DO this???? Nothng has chnaged except for his new girlfriend moving in (and disagreeing heavily about the terms we decided upon) ...we have gotten along famously throughout this whole year, and now he's - and I quote - ''dispassionate.'' and wants to re-do the whole thing. The CR2A and everything has already been filed w/ the court...does he have a hope in heck of changing this???

Re: Scared to death!

As Ms Powell said, he would be laughed out of court, except he could well be the only one not laughing, as you could potentially seek attorney's fees for defending the CR2A, some CR2As are explicit on that point.

Re: Scared to death!

A CR2A agreement is like a contract, enforceable by its terms against a party who has signed it. He can change his mind, but a judge will not entertain any argument that would allow your ex to decide he wants a different deal. Stay dispassionate, which means be brave. He'd be laughed out of court for now saying he wants to change the terms.

Hope this helps. Elizabeth Powell
