Selling assets

I want to take a trip out of town that my husband does not want me to take. He has threatened to sell everything - car, house and contents - while I am gone. Can he do this? I am the primary on the car and my name is on the title of the house but not the loan. Besides all the contents in the house.

Boy, that's a loaded question! You are a grown woman and can do as you please. If your husband has threatened you with disbursing community property, you need to take a different look at what is going on here.

Your name on the title to the car or the house is not relevant to the issue of who owns it. You BOTH own it - as community property. You each have an undivided one half interest in your property - no matter (really) who picked it out, who pays for it, or whose name it is in.

WA is a community property state. Every penny you earn is half his, and every penny he earns is half yours.

That said, if my spouse used that level of threat to convince me not to leave on a trip, I would be running to find the best divorce attorney possible.

You don't say whether you have children, and whether you are their primary care provider or not. I don't want to read too much into your question, but if you were, leaving on a trip right now would be the height of folly, because your spouse sounds as though he's completely ready to shut you out.

If you have ever considered whether or not you are facing domestic violence in your relationship, the answer is YES, YOU ARE. This controlling behavior is a symptom of a flair for the dramatic coupled with a need to control you. It is dangerous.
