Legal Question in Family Law in Washington

Split of retirement benefits

In the divorce decree my ex received 50/50 of my military retirement (Oct94). I would receive 50/50 of her civil service. Since 10/94 she has had all that time to build up 20 years and she still has not retired. Also she has not let me know where she is.

Re: Split of retirement benefits

She gets to determine when she retires. You need to contact the attorney who wrote your decree and make sure there was a qualified domestic relations (QDRO) written re both retirement funds, and then your attorney can contact the plan administrator and make sure things are on track.

It doesn't really matter where she is because the decree is enforceable against her retirement, and you can find them.

Hope this helps. Powell
