Spousal Maintenance

My wife and I are legally seperated and I want to purue the dissolution. What do I have to do to get the Spousal Maintenance modified before I start the conversion

Re: Spousal Maintenance

It depends on where the obligation for the mainenance comes from. If it is a decree of separation, there may be conditions under which maintenance stops or it may be non-modifiable.

You can "convert" a separation into a dissolution, but that triggers a new waiting period (90 days) and you have to file a motion for an order converting the action and file a new petition and depending on the particulars, perhaps a new summons.

This is a good time to lawyer up.
