can i as a step father get legal guardianship of my step son

The general answer is that any competent adult can be the guardian for any person who is under a disability (that reduces their ability to manage their own care or estate). Whether you can or should petition for guardianship or whether you are the most appropriate person to be the guardian is the question and the answer to that question is controlled by many factors.
