my 13 year old daughter loaned her cell phone to a friend during class time the phone rang and the phone confiscated by a teacher. The teacher handed it over to the principal who read all her text messeges. Isnt this invasion of privacy?

Probably not. There are rules allowing schools more leeway to search student's property, which would include the cell phone. Schools can search backpacks and lockers. There is an overriding interest in the safety of other minors who have a mandatory duty to attend school. Thus, courts tend to uphold searches that under other conditions would probably not be allowed.
