can i get my aughter away from her father if he is allowing her to send and recieve nasty -mails

In order to modify a parenting plan you have to demonstrate a significant change in his circumstances (not yours) such that it is in the child's best interest to change her primary residential placement.

I don't know if nasty emails would qualify or not, having not seen them. If he's leaving her alone and she's on the internet unsupervised he's asking for trouble.

The other thing you could consider is contacting CPS where he lives and telling them what is going on.

Does your parenting plan have a dispute resolution section? Can you take him to mediation to deal with the issues you are uncomfortable with?
