Unfair Ruling
I filed for child support modification in May 2007. I asked that our daughters' gymnastics and daycare expenses be included in the transfer paymnt as it was a hassle contacting my x for paymnt each month. The comissioner ruled not to included them but reserved the right for me to come back and have them included if he did not pay on time. In addition she advised that it was not my responsibility to call & remind him when pymnt was due, but that it was his responsibility to pay on time. My x has not made a pymnt since 6/07. I went back to court with documents showing what he owed and asking it be included in the transfer pymnt since he had not pd on time. Pro-Term Commissioner now on bench while original commissioner is on leave rules against what the original commissioner stated and does not include the expense in the child support pymnt. How can one commissioner rule against a previous commissioner's ruling? What type of action can I take to have the case heard by a different commissioner/judge?

You can file a motion for revision (takes it from the commissioner to the assigned judge). You have to do this within 10 days of the commissioner's ruling. At a motion for revision only what was in the record for the hearing you are seeking revision is available to the judge.
