Legal Question in Family Law in Washington

violation of rights of personal information

A CPS worker who has been off my case for a year spoke with a DSHS worker & asked her questions on whether I was complying, he found out I requested a phych eval, he stated in court that I had a hearing coming up through dshs and implied that it was due to speculation of my twin doing my phych eval. prior incidents involve the respondents lawyer calling task where i UA at & telling them she thinks my twin is ua'ing for me, my fingerprint was on my UA's. She also called the prosecutor and told her i was breaking the release conditions of my criminal charge by visiting my daughter (also court ordered) and leaving spokane. Not knowing my charge was set to be dismissed up untill then I took a plea. She has called my probation officer and treatment facilities to make false accusations about me and to check if I am in compliance. This lattorney somehow got a cps worker who had never even been on the case even when it was open to call a daycare lady and tell her she could not supervise visits between my daughter and I therefore canceling visits. Can U please tell me if the cps worker had a right to speak with dshs about me & what can I do? & What can I do about the lawyer callng places I go to in hopes of causing problems? thank

Re: violation of rights of personal information

Your question is not entirely clear. You should work on making it more clear or have someone help you with writing it when you contact others. However, the prior caseworker, presumably with the CPS, has a right to express her concerns to the present worker. Whether she was truthful or accurate is, of course, another matter.

However, I would suggest you go to the OFCO website (Office of Family and Children's Ombudsman) at http://www.governor.wa.gov/ofco/ and print out, fill out and file a complaint. Because of limited staff, they don't get involved in all complaints they receive, but they do retain information when they receive complaints about a caseworker.

Here's an interesting article from Spokane: http://fightcps.com/2007/06/22/washington-spokane-city-councilman-exposes-and-lambasts-cps/

I would also suggest you fill out and submit a request for all your records. Here is the site for the request form: http://www1.dshs.wa.gov/word/ms/forms/17_041.doc Make sure to get a copy with their received stamp on it when you turn it in.

Finally, contact your city councilman and legislators.
