Legal Question in Family Law in Washington

Visitation Rights/Privacy Invasion

My exhusband & I have 3 children. He has custody. A warrant was issued for non-payment of child support. I never went to court on the support issue because I wasn't served with papers. He told the court he didn't know where I lived (lie). I'm on SSI disability. Last month I had an appointment with my counselor at the state. My exhubands wife was sitting in the parking lot she called the police and I was arrested. I later learned that my ex-sister-in law works there and she had access to my file. She gave the information to my exhusband. I filed a complaint and it is being investigated however they confirmed she did get into my file. Yesterday I saw my ex-sister in law driving past my house and I live on a dead end street. I feel I'm being stalked. What can I do? This has got to end.

Re: Visitation Rights/Privacy Invasion

You need to contact private counsel or DAC; if you are at risk of incarceration you have a right to counsel. Use it.

If your ex sister in law abused her position to gain access to health care information which is confidential, that is a whole other problem. The Health Insurance Privacy and Portability Act (HIPPA) has its own separate remedies for violations. Google it, see what you find, and see if you can find an attorney who can help you with this.

If your ex sister in law comes back, go ask your district court for an anti-harassment order. BE SURE not to accidentally foreclose your ability to hold her liable for the HIPPA issue in the context of the anti-harassment order.

But you have to get this child support issue straightened out. DSHS will do this administratively if you request it.

Hope this helps. Elizabeth Powell
