Visitation for an ex wife

When my daughters father and I wrote up our parenting plan we put in there that his wife could take my daughter 4-6 hours every other weekend so she could visit with her siblings while the father was out to sea(he's in the navy). Since then he has been transferred to virginia and I have also come to find out that they got a divorce in may of 2003. I don't see any reason for his ex-wife to continue having my daughter for visitations. I have told her that she can bring my daughters siblings to my house to visit or we can meet in a neutral place. Do I have to continue to let her take my daughter for visitations now that they are divorced and dad is not out to sea but living in virginia? Thank you for your help

Precise language is the key to what you have to do. Precisely what does the parenting plan say? Does it say his spouse (as a title) gets to take the children or does it say a person (by name, for example: Mary Smith)? If it is personal, she may have a visitation right, if it is positional, then she lost that with the dissolution of marriage.

If it is personal you need to do a modification of the parenting plan. If you and your husband agree on the modification you can just do it. I would say you should give the former spouse notification, because she is named as having some visitation involvement.
