Legal Question in Family Law in Washington

visitations with special needs child

Myhusband, of 5 years, has left my two sons, 11 and 4. My youngest is autistic and cognitively handicapped. I gave up working so I could take care of him, and get himback and forth from all of his therapy sessions. I now work part time at night and run him to his sessions during the day, as well as take care of my oldest sons sporting events, etc. My ex lives with his mom and comes to see the kids randomly. I want to make this seperation as easy for all of us as possible...however...my youngest is very rigid in his schedule and routine. He is dependent on his enviroment, I have set up special picture systems in our home, he has trouble when a stranger walks into the home, and now my x wants to have him spend the weekends at his moms house with them. I am in a panic...my son will crash! Will the court take this into consideration?? How do I find a lawyer who will understand our situation? please help!

Re: visitations with special needs child

My best advice: Go find the best family law attorney you can. In Spokane, you cannot go wrong with Pete Karademos. If he's too busy, ask him for a referral for somebody he likes. Or, take a look at avvo.com ( a v v o).

The Court will take into consideration the information of which it is aware. When you have a special needs child and that child needs reasonable accomodation, the Court can appoint a guardian ad litem to investigate and report to the Court what is in the child's best interest. If the child's medical provider can speak with the GAL and corroborates your observations, the Court will enter a plan consistent with your child's needs.

But the effective way to make this happen is to start by hiring counsel. Hope this helps. Elizabeth Powell
