Legal Question in Family Law in Washington
Void or nullify a divorce?
My ex husband & I have been divorced for about 3 years. We want to remarry - His retirement states if he gets divorced & remarries the retirment goes away. It does not state anything about what happens if you remarry the same person. We were married 34 years prior to the divorce. He wants to see about nullifing the decree. I can't find anything about this in Washington Statutes. Is this possible?
Thanks

Re: Void or nullify a divorce?
The process is called vacating the judgment. Your problem with this process is that there needs to be reason, e.g. fraud, mental disability, minority, etc., and the time limit is usually one year from the entry of the decree (or curing of the disability or reaching the age of majority). I would suggest that the better approach is to look closely at the employment/retirement rules. I would be available to help you with that.
