Legal Question in Family Law in Washington

waiting period for step parent adoptions

After a re-marriage,is there a waiting period in Washington state before the step parent can adopt a child? and I realize that the absent parent needs to give their consent,is there a legal form that this consent has to be submitted on or can the absent parent submit it in writing in their own words?

Thanks for your time,

Re: waiting period for step parent adoptions

As to waiting period, it is a practical matter. I generally caution clients to wait to let the marriage settle in. Since a post-placement report is required, I would imagine the investigator my have some of the same concerns. But then, maybe not.

As to the form for consenting to adoption, I would recommend you contact an attorney to handle the adoption.

If you wish to handle the matter yourself, a good law library may have some books which could guide you through the process. The law regarding adoption is Chapter 26.33 RCW at http://search.leg.wa.gov/wslrcw/RCW%20%2026%20%20TITLE/RCW%20%2026%20.%2033%20%20CHAPTER/RCW%20%2026%20.%2033%20%20chapter.htm. The requirements of the parent's consent are at RCW 26.33.
