Legal Question in Family Law in Washington

Washington State child custody laws

I have been told that Washington state law allows women full custody of a child unless neglect or some other major extenuating circumstance applies. I was just wondering if this is true. One of my friends is going through a divorce, and is sure that he will not recieve custody. Is there anything he can do? Or is what I have heard correct.

Re: Washington State child custody laws

Generally, if both parents are fit parents, then the parent having custody at the time of the date of separation usually retains custody. There are always exceptions to this rule, e.g., one parent is abusive toward the child, a habitual criminal, engages in dangerous activities or acts out sexually in front of the children. But, absent such compelling factors that would mitigate against a mother retaining custody, she will probably get it.
