Legal Question in Family Law in Washington

My ex wifes attorney is slandering me..

my exwife's attorney is slandering my character in writing to GAL stating that I am harrassing and bullying my exwife becasue I filed for a motion to compel for interrogatories that was due June 17th of 2007. He is stating that I have threaten to make this case as exensive as possible for her, which is not true. He also wrote that I have hit his car with my fist when he served me their response, which is a lie. I have resonded in a very respectful way to all his accusations with CC to the GAL, is there any other action I can take to have him stop slandering me?

Also, I have temporary orders for visitation with my daughter (Every other weekend) The Commissioner instructed me to be involved in her schooling, so when my daughter has after school functions/activities I have attended. The opposing counsler informes me that I have no authority to be there as it is interference with the mothers visitation time. It is valuable time with my child that we both enjoy very much. Can I file for a ''clarification of the order'' as it was only verbally the Commissioner stated involvement at school?

In addition to Ms. Powell's advice, I would suggest you directly address his points in writing to the GAL. Write as if you were writing to the judge or commissioner. Don't use inflammatory statements like "you are lying". Give a calm and rational response. I can assure you that if you do "go off" in writing, the judge will see it sooner or later. On the other hand, your calm response will speak well to the GAL. At the end, ask him/her to get back to you if they have any questions.

Some of what he has said comes from his client. Some may come from his own misperception--for example, if you touched his car in some way, though innocently, harmlessly and/or absent-mindedly, he may have perceived it differently.

If he is just an out and out liar, keep good notes and send it to the Bar Association.

And to echo Ms. Powell: get a lawyer. If the other lawyer is a bad apple, you will be well-served to have a buffer rather than one who will twist your words or trip you up.

The GAL has been here and seen this before. Your ex's attorney's conclusions don't carry a lot of weight with a decent GAL.

Theoretically the attorney is not testifying because he isn't a witness.

The opposing counselor (your ex's atty again?) knows what the court said. If the opposing counselor's position is oncorrect then yes you can bring a motion for clarification based upon the commissioner's verbal order. You will need the transcript.

I certainly hope you have a lawyer. If you don't yet, please go get one.
