Withholding property

My spouse and I are going through a dissolution process and are separated. However, due to space constraints at the time of separation I did not move all my belongings. Now that I have space, I have tried to move some of those belongings and my spouse has been denying me access to them, telling me that we need to wait until the divorce is final. All of the items were mine prior to the marriage or gifted to me during the marriage. What should I do? Can I get a court order forcing my spouse to release them to me?

Yes, you can make a motion for temporary orders, specify what is yours. I would encourage you to attach any documentation of agreement as to disposition of property, purchase documents or cards conveying it as gifts to you. Most of my family law practice is in King and Snohomish Counties.
