Legal Question in Family Law in Washington

Writ of habeas corpus

I would like to know if I can present a writ in front of the judge myself (because I'm indigent) for a habeas corpus dealing with the removal of a child. And two: how much is the filing fee for the state of Washington? Thanks.

Re: Writ of habeas corpus

If you are truly indigent pursuant to the court's standards the court would likely waive the filing fee. Most law libraries or court facilitators will have sample motions for you. A great resource for pro se parties is www.washingtonlawhelp.org

Re: Writ of habeas corpus

If you have an already open family law/paternity case, you can file it within the existing action. If there is no existing action, the filing fee is probably going to be the domestic action filing fee: $240.00.
