Legal Question in Medical Leave in Washington
last year my son went through 3 surgeries for a broken collar bone in 4 months. my HR mgr said that since the insurance companies said 97% of those injuries healed on their own she didnt think it warranted FMLA. I constanty, and still feel like my job is threatened. On my last review in April 2009 she gave me a low score on my attendance counting not only those absences but the (about) 100 hours of vacation time I had cashed out during the time my son was having his surgeries.
now, I'm the HR admin assistant. I've tried numerous times to explain FMLA ADA and Disability laws to her only to be told that if i value my job i will follow her orders and not answer any questions that will release any information on the laws to the staff. i know of 2 ppl in the officee that should be on FMLA protection but she has told me that if they come up knowing the laws she wll know where they got their information - me. they both feel threatened also.
she says that if she denied me FMLA when my son had 3 surgeries she has the right to base her decision on my sons injury - is their situation worse than mine etc...
everytime something comes up about her violating someones rights i have my job threatened if i say anything, but what can i do? i give people the information they need and hope that she doesnt find out.
