Legal Question in Civil Litigation in Washington

Animal Resold- without Refunding money

I saw a dog, contacted listing owner, spoke to her then she offered me a dog at a certain price, I sent all the money, she them went to have dog evaluated and sold the dog to the woman who evaluated dog for the same price I paid. I have sent many e-mails, have received No contact or e-mails back. What rights do I have? I have proof that the new owners have paid for the dog. Since I did not get my money back prior to the woman re-selling the dog, who is the rightful owner? Can I file Internet fraud? The new owner knows everything including me paying for the dog in full prior to the meeting. At this point I have to be nervous as the new Owners have a pending trial Scheduled against them for to many dogs, so if they were to get called on again, Animal Control could seize all dogs including the dog I paid for, the woman who sold the dog I believe does not know. If I got to court in another state is it true that in some cases Judges will reimburse for Airfare for having to fly across the Country, and other costs for traveling for the seller just being Dishonest?I really am begging for help with this, so that I can get some closure.

Re: Animal Resold- without Refunding money

Sorry to hear that this was such a bad deal for you.

The attorney I know who does a lot of work on interstate cases of animal sales that go sour is Paul Mabrey. He's in Gig Harbor, WA. He used to be a vet, so he understands animals.

I know that he has taken on cases such as yours where a WA seller breached a contract with an out of state buyer.

You can find him at wsba dot org under lawyer directory.

WA has a Consumer Protection Act that provides for treble damages and attorney fees to be paid to the prevailing party by the losing party so yes, you may well get your costs and fees reimbursed if the judge agrees with you.

I hope you are able to follow up with this. Hope this helps. Powell
