Legal Question in Civil Litigation in Washington

Broken TV delivered

I ordered a $2000 plasma TV from a reputable dealer, and when it was shipped some very notable damage was done on the side of box. When it was delivered to our house my wife mentioned it to the delivery guy and he cut the box open and inspected the side of the tv and there was no damage so he had her sign for it. When I came home and opened it all the way - the screen was cracked (in the front, but on the same side as the hole). When I called the guy I bought it from, he said that the shipping company doesn't want to pay since we signed for it. My wife made sure the delivery guy knew it was damaged, but sure enough on the bill of lading he didn't make any note other than ''not intact''. Do we have any leg to stand on?

Re: Broken TV delivered

You could contact your homeowner's insurance and make a claim if the seller is refusing to make it right.

It's hard to say whether this is valid or bogus, I can't tell.

If I was receiving a $2K TV and there was the slightest hint that the thing was damaged, I would have made the delivery guy stand there until I had inspected each and every inch of the thing, taken pictures of it, called the store immediately, called the delivery guy's company to say there was a problem, written my description of the damage on the packing slip and had the driver sign it, and otherwise documented the problem with the thing BEFORE allowing the delivery person out of my sight.

So, I don't know. Hope this helps. Powell
