Legal Question in Civil Litigation in Washington
I have filed sizable the pro-se lawsuit against corporation and have two questions.
[1] Does the 20 days Summons counts only the business days or all calendar days?
[2] Does the Notice of Appearance filed by defendants lawyer satisfy the requirement of answering of the charges spelled in the Complaint attached to the 20 days summons, or does defendants lawyer also need to response to those charges?
1 Answer from Attorneys
(1) All calendar days, except if the 20th day falls on a weekend or holiday, go to the next business day. See CR 6(a)
(2) The lawyer still needs to respond, but you must give him notice if you make a motion for default for his not answering. See CR 55(a)(3). Essentially the NOA is a place-holder; he may wait to file the response after you file the motion for default.
