filing a civil lawsuit for money loaned.

i loaned money to a boyfriend a couple of times starting in may 2008, we have since broken up and he has made no attempt to pay me back despite repeated attempts by myself to collect the money. is there a statute of limitations for collecting on money you have personally loaned? and how do i go about filing a civil suit? do i need an attorney to represent me. i should say also that he fraudulently used my debit card and i have turned that matter over to the bank. thank you for your time and consideration.
