Legal Question in Civil Litigation in Washington

Homeowner board member stole $35,000

The country prosecutor has a case from a police detective who found $35,000 stolen from our neighborhood. We cannot afford an audit so the prosecutor can prosecute, so we are wondering if we can sue him? What information would we need to have available? We do have all the police research. Does an attorney work for a percentage?

No attorney is going to take this case on a contingency recovery basis. Your question made no sense whatsoever until I saw your headline. Do you mean that somebody on your Board of Directors has been misappropriating funds?

That person needs a criminal defense attorney, preferably one who understands white collar crime.

Also - your HOA should have errors and omissions insurance. Find out. the HOAs defense may come through the insurance company. If the individual was doing the wrongful act but the board was OK, determine whether the individual has insurance, or possibly a bond.

No, you cannot sue the prosecutor for doing his job. You cannot sue the judge if you lose either.
