Horses kept at a persons place. now where are they?

We had our horses at this persons house, She moved the horses and herself. Refuses to inform us of where the horses are. We sent a check to her old address per her instructions (certified mail) for board,marked the check board payed in full she accepted and cashed the check. Now she is trying to charge us more board. Not telling us where the horses are. Ignoring all attempt now at contact over the phone. Threatining to dispose of the horses. There is no written or verbal aggrement for any board. we do have the registration papers on the horses.

We have talked with the police they say find a lawyer.

what are our options now.

I'm sorry for my brusque reply earlier, I was really busy. I will try to slow down a bit now. There is a law that covers horse board situations; it is found at RCW 60.64 or thereabouts. This is an Agister's Lien issue turning into a theft of livestock issue. It is unlawful to take your horses without any notice or opportunity to get them back, even if you owe the poeople $. There are other laws that apply as well, such as theft of livestock which carries a treble damages and atty's fees provision. Doesn't stop them, though, and you've all ready discovered the police are useless. I suggest you contact the Brand Inspector, Gary Moon, with descriptions of your horses and the situation, and contact the auction houses and tell them your horses are gone. There are websites for posting lost and stolen horses, you should get signed up.

Mr. Mabrey can help you with a replevin action which is an action to order these people to hand over your horses. This is simply not something I suggest you try to do yourself - I wish you all the best and I hope this helps you get on th right track towards recovering your horses. Powell
