identity theft

can I sue someone who was convicted for identity theft? I recieved money for the time I took off work, but I wonder can you get pain and sufferung. This happened in washington state I now live in virginia.

You can sue civilly for conduct that resulted in a conviction under some circumstances.

First hurdle is whether or not all your claims have all ready been litigated. If you haven't been compensated for your pain & suffering, chances are you still have that cause of action. You might want to call it outrage. That has a shorter statute of limitations, though.

Next question is: what's that worth? And after that, who will represent you? If you are 3K miles away, that's going to be a little tough, but not impossible.

You might take a look on line for somebody who is in the location where this happened, and see if you can sell a lawyer on taking your case. It's worth that much investigation.

If I understand your question, you were the victim of identity theft while residing in Washington State. I will assume for purposes of this answer that the individual who injured you is a resident of Washington.

You may have a civil cause of action against this individual in Washington. To determine whether a lawsuit is in order, you should explore the following questions with an attorney: 1. How likely is it you could actually recover money from the person who injured you; and 2. What potential claims do you have. I would need more facts to answer these questions.
