Legal Question in Civil Litigation in Washington

Personal loan

I loaned an ex girlfriend $20,000.00. We did not write up a contract. Do I have any chance of recovering my money.

Re: Personal loan

You've probably noticed that a verbal contract is worth the paper it's written on. However, if you can prove your case a court will enforce your remedy.

You DO have a piece of paper - the check. The check identifies the parties, the date and the amount of the transaction. You'll have to prove that the money was not a gift, but a loan.

Perhaps you have correspondence - emails? between you and your ex regarding repayment of the money.

I'd need to know a lot more than what you provided. So, my answer is "maybe" you can get a judgment, maybe not. Depends on what you can prove.

Good luck - Powell

Re: Personal loan

There is always hope, but it will depend upon what you can prove in court. An oral (spoken) contract for a monetary loan is valid. If she denies owing the money, it can be a little difficult to prove, but if you have any sort of paper trail, (check, letters, emails) or witnesses to conversations regarding the debt, you may have a shot.
