property from a previous marriage

I have property from before I was married. I wanted to know if this is something I have to split with my current spouse.

All property of the parties, separate and community is before the dissolution court for a just and equitable distribution. That is what the statute says. The caselaw modifies that sweeping generalization.

To answer your question, it depends.

Your teddy bear from when you are three is yours. Your money market fund that you put money into after you got married may have a component that is community.

Bottom line is have an attorney review your situation. Also know that if you try to hide assets, the court may not think highly of you, and that can cost you money in the long run.
