Small Claims Court Procedures

1. If my husband and I together file a small claims suit against our homebuilder, do both of us have to appear in court, or can one represent both?

2. If notice is served by mail to a husband and wife who are owners of the business we are suing, do both have to sign the post office return receipt as proof that notice was served, or is one signature sufficient proof?

1. Generally one can represent both. It would be better if both of you appeared, however. 2. If business is sole prop or partnership owned by the husband and wife, then one signature probably sufficient for proof of service.
