Statutory rape (and possibly emancipation?)

My girlfriend is 16 years old, and i'm 19. She intends to become emancipated shortly, and then she is going to move out of her mothers house and into an apartment of her own. When she moves out, she wants me to move into her apartment (two bedroom, one for both of us). This has me concerned, because i'm worried her mother might make statutory rape accusations to attempt to get me out of her daughters life. While her mother doesn't object to me off hand, i'm afraid she might if I move in with her daughter. Can she simply accuse me of statutory rape and have me arrested? Does she need proof that we've had sex? I've looked into the laws concerning it, but honestly, it's all greek to me. Any help would be much appreciated, thanks!

The issue of whether or not she is old enough to consent is answered by the difference in age between you, measured in months.

You would do well to pay careful attention to that answer, as it is the difference between having a life and being labelled a sex offender and having to register, etc.

Yes, you can be arrested on somebody else's word. Happens all the time. If this happens, be sure to not say anything without consulting with counsel.
