Legal Question in Civil Litigation in Washington

summons and complaint form

Where can I download a summons and complaint form for superior court in King County Washington? I need to file a claim against a painter's bond company as part of an effort to recover money spent for the painter's aborted job.

Re: summons and complaint form

There really isn't such a place, with the possible exception of Washington Practice but I do not know how to direct you there on line without it costing you a fortune. However, it is very easy to go to a law library and look at the Washington Practice series and find a sample complaint.

Filing a complaint against a contractor's bond requires that you assert jurisdiction, venue, parties, your cause of action, your facts and your request for relief. You also need to verify the complaint. Resist the urge to use words like "said" or "heretofore" or to refer to yourself in the third person.

Obviously I am greatly simplifying this answer because there is more to it. About two years ago the Bar rewrote the rules about "unbundled" practice so that attorneys can do some of the work on a case without being responsible for the entire case. Your problem suggests that spending an hour with an attorney so that your pleadings can be correct would be a really good use of your time and your money.

Yes, it is a complete pain. But losing because of a technical or substantive defect in your pleadings is a lot worse. Good luck with this. Powell
