Legal Question in Civil Litigation in Washington
Verbal contract question.
I met someone at the local hobby store and we enetered into a verbal contract in which he would build a Easy Glider RC plane for me for between 40-60 dollars, depending on how much work needed to be done. This man wass suggested to me by the stores owner as he is a regular there and well known.
I have not heard from the builder in 2 weeks even after repeated attempts to contact him. Did I just lose a 300 dollar RC plane or do I have any recourse? I do have a voice recording of him on my answering machine, talking about the Glider. Any advice would be greatly apreciated. David

Re: Verbal contract question.
Talk to the people at the store and don't assume everything has gone bad. Leave them room to make things right. Otherwise small claims court.
Re: Verbal contract question.
You can have oral contracts in WA, and the court will enforce them. You need to be able to prove the offer, the acceptance, and the consideration so as to show the meeting of the minds.
Here, you offered to pay him money, he accepted by taking the plane with him, the consideration is the plane itself.
Save the voicemail recording and have a professional transcribe it for you.
It may be he just got really busy or distracted. If you WRITE to him, and tell him nicely that you are looking forward to receiving the plane, you will have a document to show the small claims judge.
Small claims can get you money, cannot make anybody do anything except pay money.
Hope this helps. Elizabeth Powell
