Legal Question in Health Care Law in Washington

Health care coverage

Is it legal for my health care provider thru my employer to refuse to cover my spouse and myself via ''dual coverage'' since we both work for the same company. They will allow ''dual coverage'' if one of the spouses works elsewhere however. Is this not robbing us of coverage and discriminating based on the fact that we both happen to work for the same place? This seems to me that we are not getting the same benefits that other empoyees are.

Re: Health care coverage

Your health care plan is probably a qualified plan under ERISA and as such the plan administrator has pretty much carte blanche to do whatever he likes in terms of dual coverage.

However, there may be special laws that apply in WA, and if you are concerned about this, see an attorney in WA to discuss the matter.
