Legal Question in Immigration Law in Washington
Alien Father Child Support Unemployed Due To Alien Status
My fiance has just found out he is the father of a child concieved in this country by another woman before he met me. He is not a U.S. Citizen at this time and we have a financial questionaire that we have been asked to fill out. He has no work visa or green card untill months after we are married. He is technically unemployed. However, he has been working odd jobs under the table. Since he has no SSN or Tax I.D. we can not claim that income and it is not very much. Less than $600/mo. I made 19,000 last year and will make less this year. In the questionaire it askes all about his income and the income of those he lives with. If we mention the odd jobs we risk trouble with the ins and if we do not can the state access his bank records and show that he has an income even if he does not have a job? He wants to pay child support and see the child as much as possible, but we do not want him to be deported. Do we say he is unemployed? How and why does my income matter? Help!

Re: Alien Father Child Support Unemployed Due To Alien Status
Your question sounds like it has more to do with income tax law than immigration! You did not mention who is sending you questionnaires to fill out or if they are immigration related. Are they?? If you have an INS form, please reply again. Thanks.
Also -- if you are thinking of making a petition for your spouse, that is something that we might be able to provide advice on.
