Legal Question in Immigration Law in Washington

circumstances out of control

Iam agreen card holder, stayed outside the state almost 2 years and re-entered with a re-entry permit . that was because of cicumstances out of my control ( sudden death of my husband overseas ). can i apply for naturalization and consider the 2 years as a residency period in the state?

Dear Inquirer:

No. The reentry permit preserves your resident status, but does not preserve "residency" for purposes of naturalization. Generally, if the chain of residency has been broken, you may file for naturalization 4 years and one day from the date on which you resumed your US residency.
