Gaining citizenship for a father of a U.S. Citizen
I have an employee who is married to an american citizen and has a a daughter of almost two years. This employee has worked for me for the last three years. He was told that because when he was an infant his parents brought him into the country illegally from mexico he will have to return to mexico while thay decide his citizenship. This leaves a wife and daughter not being provided for and a position at work not filled. Is it really a necessity for him to be temporarily deported and if not how would he go about staying?

The answer to your question lies in whether or not the individual to whom you refer made a qualifying filing prior to April 30th, 2001 with the Legacy INS or the Department of Labor (or its designee).
