Legal Question in Immigration Law in Washington

I am currently on a H1B that expires 09-26-10. My current employer plans to apply for renewal in the month of August. I am looking to do a H1 transfer

1) Can the H1 transfer and the H1 extension happen simultaneously ?

2) Can i apply for a transfer with just a month or so left on my current H1B?

Thanks,

N

Hi,

Both the extension and H1B transfer can be simultaneously filed. There is no limit to the number of H1B petitions that can be filed. We have additional information here: www.h1b1.com/concurrent.htm

Under H1B portability rules, you can normally work for the new H1B employer upon the filing of H1B petition; you do not need to wait for approval.
