Immigration processing times

I have an application pending for an immigrant visa through a family relative. The date now is current (Texas center is processing applications as of may 7, 2001, my father, the petitioner upgraded the petition sending a letter with a copy of the naturalization certificate. My notice date is feb 13, 2001). Assuming the ''waiting'' period is over and now they are in the ''processing phase''. My question is: How long is this processing phase? How long will it take to get a response from them (either request for evidence or approval)? I have an H1-B which will expire in October, just want to make sure if I need to renew it,or wait?

It depends on whether there is a visa available. If there is a visa available then you can adjust your status LPR, if there isn't a visa then you will need to renew your H1B status. We need your Notice of Action form I-797 to determine whether you have a visa available to you or not. To renew your H1B we charge a flat fee of $2000. For adjustment of status we charge an hourly rate $175 and they usually run $1-3,000, depending on your history of difficulties with immigration or law enforcement.
