Legal Question in Immigration Law in Washington

Can love win?

I am a green card holder-permanent resident of WA state. My girlfriend is currently in USA on a 3 month B2 visa. For some reason immigration officer stamped B1 on her I-94 record. Is there a way for her to stay in America ( as long as possible)? If we were married in USA,would that change anything?

Re: Can love win?

I understand your predicament. Unfortunately, there is no quick solution to the problem. Getting married would be a long term solution in that she could apply for a visa as the spouse of a LPR. However, it looks like the wait on that is a few years. If you were to become a US citizen she could immediately apply as your spouse. However, it is possible that you are not yet eligible to naturalize. Either way, the process will take longer than her current authorized stay. The only advantage of getting married now is that you wouldn't have to get her here (or you there) for a marriage some other time. However, you do not want to get into trouble by marrying and getting a claim that her b visa application was fraudulent. Contact me directly if you have further questions.
