Legal Question in Immigration Law in Washington

Tourist Visa Re-entry

I have been in the US for several months on a tourist visa staying with friends. My I-94 expires soon and I will be leaving before the expiration, of course. But I would like to come back into the country quite soon after I leave. Is that possible? I have a 5 year multiple entry visa. For instance if I left and went to Europe for a week and then came back into the US to stay for another month for instance, would I have any issues getting in? Assuming I could, what would my new I-94 say? Thanks in advance.

Re: Tourist Visa Re-entry

There is no certain answer to your question. It all depends on whether you will be able to convince the immigration officer that you will leave the U.S. at the end of your visit. This may be difficult to do since you will have just been in the U.S. for several months just weeks before seeking re-entry. Nevertheless, there is no prohibition on seeking re-entry after such a short time, but it makes it more difficult. So, you should be prepared for a possible denial. Your new I-94 will reflect your new authorized period of stay (e.g., 30 days to 6 months).
